Fee structure example
Terms & Conditions of Hire Agreement
The hirer or his duly authorised agent, agree to the following :
1. This quotation is valid for 14 days only
2. COD Accounts to be paid before work will commence - Complete COD Invoice to be submitted.
3. All rates hired on DRY rate excluded fuel
4. Driver is included in the service provided.
5. Operator accommodation is for client account
6. Minimum plant hours per day @ 8hrs
7. Minimum plant hours per rain/Inclement weather day @ 4.5hrs
8. Minimum standing time per day for unforeseen circumstances @ 6hrs
9. Overtime on operator will apply for Saturday @R90.00/hrs, Sunday & P/Holiday @R130.00/hrs
10. Office to be contacted before 09h00 for reduced minimum plant hours per day or item 6 above will apply.
11. Minimum hours per day will be billed for on short Fridays.
12. All plant & Equipment is billed on MAN Hours and NOT MACHINE Hours.
13. Additional medicals & clearances will be for the client’s account.
14. We will be responsible for timesheets completed and signed off correctly.
15. Clients are billed according to timesheets received and per our stipulated in this quote
16. Breakdowns & Defects must be reported before 09h00 or item 6 will apply
17. Suitable arrangements must be made with Head Office - for operators working overtime.
18. Cost of repairs for damage and/or abused plant will be for the clients account, this includes tyre damages.
19. Any damages caused to the water truck and/or theft will be for the client’s account.
20. Security is for the client’s account. Safe keeping & storage of water truck, spare wheels, buckets & batteries is the sole responsibility of the client.
21. Any damages caused by the Operator of the plant to the site or any other property will be for the client’s cost, as the operator is under the supervision of client.
22. Interest of 2.5% per month will be charged on overdue accounts
23. All legal costs will be for the clients account for collection of outstanding accounts Indemnifies the OWNER (Plant Index) against any claim that might be brought against him by any person(s) hiring the equipment/driver.
24. In or about 50km radius work place from Saldanha EFP (Pty) Ltd driver will return to company accommodation in Vredenberg with company transport at the end of each daily shift.
25. This agreement records the whole agreement between EFP (Pty) Ltd and the client and overrides all other agreements to relate to the hire of the water truck and collateral verbal agreements are expressly excluded.
25.1 1No conditions terms or representation not expressed herein shall be binding on EFP (Pty) Ltd.
25.2 No variation shall be binding on either of the parties unless agreed to by EFP (Pty) Ltd and the client in writing.
